Appellant Beth Carroll Martineau brought an order to show cause to recover costs and disbursements, including reasonable attorney's
fees, incurred in defending a condemnation action commenced by respondent State Conservation Commission of Wisconsin (now
Department of Natural Resources). On October 11, 1967, respondent commenced eminent domain proceedings to condemn appellant's real estate in Jefferson county
and made a jurisdictional offer to her of $16,500. Appellant retained Attorney Edward I. Crowley as counsel in defense of
her property. Attorney Crowley withdrew; and Attorney Dale T. McKenna was hired by appellant under a contingent fee contract,
which provided for payment to him of 33 1/3 percent (or 40 percent after appeal) of any amount in excess of $16,500 recovered,
either by settlement or by award after trial.
